Contractor Compliance Under
EPF Act :Duties of Principal
Employer
A. Obtain from Contractor within seven days of close of the month -
 * Master roll
 * Wage register
 * Statement of recoveries covering all three
    schemes
 * List of new employees exiting
B. Obtain from Contractor within fifteen days of close of the month -
 * Returns pertaining to new & exiting
    employees
 * Dues-deposit statement
 * Copy of bank receipt challans
C. Obtain from contractor status of Claims/ Transfer submission to RPFC for exited members
Scope of Service :
Monthly Compliance
  Create employee database with
    monthly updates
  Create employee dossier with
    previous employment history,
    nominations, bank details,
    children particulars and so on
  Prepare monthly recovery sheet,
    challans & statutory returns
  Prepare claims & settlements,
    submit to RPFC & follow up for
    obtaining the due amounts
  Transfer ins & Transfer outs

Scope of Service : Annual Accounts

 * Prepare annual accounts - memberwise and
    companywise
 * Submit accounts to RPFC and conduct
    reconciliation of accounts with RPFC
 * Obtain annual accounts slip from RPFC

Obtaining Independent/Sub PF code for contractor :

  Prepare all documentation relevant to
    obtaining code for contractors
  Submit the case to concerned RPFC
  Follow-up with RPFC/Central PF office till
    code is obtained

     Contractor PF Compliance has become a burning issue with PF Commissioners. Principal Employers are being
issued summons notices and damages are being recovered from them. In an instance, an oil major had to pay
damages of over 2 crores for its contractors non-compliance and its bank account was also attached by EPFO.
 
      Under the EPF Act, 1952, it is categorically stated the principal employer shall be responsible for any non-
compliance on the part of its contractors and this has been upheld in various Apex Court and High Court
judgements.
