Tamil Nadu District Judicial Magistrate suspended for Sexual Harassment
A Tamil Nadu advocate has complained of having been sexually harassed by the Judicial Magistrate and has provided audio clips to corroborate her complaint. Upon a preliminary enquiry the allegations were found to be true and the complaint was forwarded to the Hon’ble Madras High Court. The Madras High Court has ordered for his suspension and the same has been executed by the Hon’ble Principal District Judge. A detailed enquiry is likely to be conducted by a panel of the Madras High Court Judges, post which further action will be taken against him.
National Database on Sexual Offenders Launched
The Union Home Ministry has launched two separate portals to strengthen women safety. The portal “cybercrime.gov.in” will receive complaints from citizens on sexual abuse of women and children.
The National Database on Sexual Offenders (NDSO), will assist in effectively tracking and investigating cases of sexual offences.
The Cyber Crime Prevention Against Women and Children (CCPWC) portal is convenient and user friendly that will enable complainants in reporting cases without disclosing their identity. This will not only aid the victims/complainants but also help the civil society organizations and responsible citizens to anonymously report complaints pertaining to sexual abuse. Complainants can also upload the objectionable content and URL to assist in the investigation by the State Police. The complaints registered through this portal will be handled by police authorities of respective State/UTs. There are other features such as a victim or complainant can track his/her report by opting for “ report and track” option using his/her mobile number.
The National Database on Sexual Offenders (NDSO) shall serve as a central database of “sexual offenders” in the country which will be maintained by the NCRB for regular monitoring and tracking by the State Police. The database includes name, address, photograph and fingerprint details for each entry.
Ahmedabad Teacher Sacked for Sexual harassment
An Ahmedabad based vocational teacher has been sacked after the woman’s development committee of an educational institution found the complaint of sexual harassment filed by its student to be true.
The Postgrad student who avails the hostel facility of the deemed University complained of frequently being inappropriately touched by the harasser.
The statement of the victim has been recorded and the harasser himself has admitted to the allegation brought against him.
Court Orders framing of charges against former Teri chief R. K. Pachauri
The Metropolitan Magistrate at Delhi Saket Court has ordered the framing of charges against former TERI (The Energy and Resources Institute) chief R.K. Pachauri in a sexual harassment case under various sections of the Indian Penal Code. The next hearing in the matter is slated to be held on 20th October, 2018. Pachauri had been accused of sexual harassment by a woman researcher who used to work directly under the accused and later resigned from her job as she felt 'let down' by TERI. The survivor in a statement after the Court's order said, " Chuffed to bits. This has not been easy. This is a big big leap towards the truth. I am relieved and exhausted fighting R.K. Pachauri".
Gurugram: US Citizen Files Sexual Harassment Complaint Against Her Office Senior
An American National working in Gurgaon, has filed a sexual harassment complaint against a senior colleague with the city police along with a complaint with the Companies Internal Committee.
In her complaint she has stated that the senior official has been harassing her for the past one and a half years which has led her to undergo psychological depressions and alike syndromes.
According to her complaint the harasser would often ridicule her and demean her in front of others calling her worthless and unfit for the company.
Once he had reprimanded her for her work and then touched her hand obscenely asking for favours which could lead to forgiveness.
She has accused the senior official of having outraged her modesty repeatedly.
Woman alleges sexual harassment by 43 of her colleagues
A Noida based software engineer working with a multinational company has brought sexual harassment charges against 43 of her colleagues.;
In her FIR, she has stated that:
• she has received sexual invites from one of her colleagues on the WhatsApp lunch group, which compelled her to leave the group in 10-15 days from the date of the incident
• in December, 2017, 20 of her male colleagues had showcased obscenity in front of her
• some of her colleagues would touch her inappropriately
The Noida police has registered the FIR and is yet to verify the charges before anyone is arrested.
Police is also verifying the CCTV footages to corroborate with her complaint.
Woman Employee of IT Company Sexually Harassed by Head HR in Gurugram
A woman employee of an IT company in Gurugram has alleged being sexually harassed by the HR head of the firm. Based on her complaint an FIR was lodged under Section 354 A (sexual harassment) of IPC against the HR at the women’s police station in Sector 51.
The 27-year-old in her statement has claimed that the HR complimented her work and on the pretext of discussing her job prospect asked her to accompany him to the stairs where he touched her inappropriately while claiming to play a key role in her promotions. The next day she lodged a complaint with the Internal Committee of the company.
The police have collected CCTV footage of the office and is awaiting the report of the company’s internal inquiry. She has further been produced to the court and her statements have been recorded where she has repeated her accusations.
Woman SP Alleges Sexual Harassment by Senior Colleague
A Superintendent of Police in Tamil Nadu has alleged sexual harassment by an Inspector General of the Police.
In her complaint she has stated that the accused had tried to hug her on many occasions and when she tried to forbid his advances, he started harassing her. She also claimed that for the past seven months, he had been calling her at odd hours and sending her inappropriate messages. Further, she has accused him of watching pornographic contents in her presence despite her objection and threatening her of making unfavorable entries in her Annual Confidential Report.
She had requested transfer but that went to deaf ears.
The woman finally approached the police and the case has been forwarded to the recently constituted Vishaka Committee of the state police office which will probed in accordance to the Sexual Harassment (Prevention, Prohibition and Redressal) of Women at Workplace Act, 2013.
The Vishaka Committee constituted has recommended transfer of this case to the CB-CID following a PIL filed by a lawyer in Madras High Court to reconstitute the Committee to include either a lawyer or a person from an NGO as an outsider.
Further, the National Commission of Woman (NCW) on August 28 has also sent a letter to the DGP asking the police department to adhere to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
