Hyderabad college flooded with protests against sexual harassment

College lecturers along with the Student Unions of a Hyderabad based college have staged protests against the Dean for sexually harassing the College's Public Relations Officer. The victim has filed a complaint against the harasser at Osmania University police station pursuant to which he has been arrested under Sections 354A (sexual harassment) and 354D (stalking) of the Indian Penal Code. Further, the accused has been sent to judicial remand.

Bengaluru-based HR accused of sexual harassment: Complainant Terminated

A Bengaluru based HR Manager has been accused of sexually harassing an HR executive. In her complaint, the victim has stated that since her initial days at the organisation back in 2017, the HR manager had been sexually harassing her. She has further stated how once he had invited her to his place under the garb of hosting a party and then forced himself on her. The complainant had approached the lady Director of her company but the Director refused to pay heed to her complaints. Further, the Director expressed her support for the Accused and issued threats for having complained against the HR manager. The Police has stated that an initial investigation indicated termination of the victim. The Police have gone ahead and called for documents pertaining to the victim's termination, to verify if the termination is a fall out of her complaint.

Govt. Sub-committee recommends changes to the India’s Sexual Harassment Law

A Government sub-committee constituted after the #MeToo wave has proposed to waive the three months’ time line for filing a complaint of sexual harassment. The committee headed by a Special Secretary level officer of the Ministry of Home Affairs, is in the process of drafting its recommendations towards the waiver which in turn will require an amendment to Section 9 of the Prevention of Sexual Harassment at Workplace Act, 2013. Till the law is amended, the sub-committee may recommend the Internal Committees to relax the three months’ time limit for filing a complaint after passing a ‘speaking order’ or after noting down proper reasons for such waiver. Some members of the committee have also suggested having no time limit for filing a complaint. The sub-committee has also proposed that Internal Committee members be treated at par with ‘public servants’ under Section 21 of the Indian Penal Code to allow them absolute immunity from prosecution, to save them from lawsuits if the accused or the employer is not satisfied with the decision of the members. The committee members are also suggesting on granting executive powers to the District as well as Nodal officers to empower them to penalize employers who fail to execute the recommendations of the Internal Committee.

Lewd comments on colleague’s FB page lands two employees in jail

Two employees of a mobile manufacturing company have been arrested by the police under Sections 506 & 504 of the IPC as well as Section 67 of the IT Act. The arrest was made almost after a month from the date the complaint was filed. After investigating the matter, the Police have filed a case of sexual harassment against five persons of the company including the HR manager for allegedly not taking any action when the victim had initially approached him. Police investigation has revealed that one of the persons so arrested had put up lewd comments about the victim on her Facebook page and had also mocked at her later in the office, while the other had verbally abused her. The Police have also issued a letter to the company asking for the details of the constitution of the ICC. However, in a statement to the media, the company has confirmed that its IC has taken cognizance of the matter, the report of which is still awaited.

MeToo stings Doordarshan

Sexual Harassment Charges Rock Doordarshan Women employees of Doordarshan have started unfolding their harrowing experiences of sexual harassment in the hands of their bosses and colleagues. Varuna Bhandari, a law firm member and a mediator with the Delhi Dispute Resolution Society had arranged a mediation session, wherein the victims spoke about their harassment experiences. She says, that one of the victims approached her seeking some relief but the issue was much more than the relief sought for. She also states that she spoke to 10 such victims hailing from different parts of India and each had her own share of experience. One of the women spoke of how two of her bosses sexually harassed her back in 2015 at which she had approached the ICC of Doordarshan. The respective bosses were proven to be guilty but much to her horror no action was taken against them, on the contrary she was terminated. More such dirty facts have started spilling, whereby two of the women employees have complained of having being sexually harassed by their colleagues but no action was taken against them. Rather these women had to face severe consequences whereby the salary of one was withheld while the other was suspended.
