Legal Metrology violation case: Karnataka High Court overturns order against prominent companies and their Directors

The Karnataka High Court has overturned of an order of a lower court against several corporate giants & their directors, based on a complaint by a Legal Metrology Inspector, in relation to violation of packaging rules. Advising the Lower Court to adopt a ‘halt & proceed approach’, the High Court held that “it is a guarantee assured to all the potential accused in private complaints residing outside the territorial jurisdiction of the summoning court that before they are called upon to make an arduous trip to the court to answer the charges, the court has doubly assured itself that they are, in light of materials available before it, liable to answer such charges”. Setting aside the cognisance of complaints, the High Court directed the Lower Court to re-initiate the proceedings and arrive at a fair decision, in terms of law.
